Portuguese Merdagate

(1)  Portuguese Merdagate - - General Explanation
The biggest Portuguese diplomatic scandal in Providence, Rhode Island

By Manuel Luciano da Silva, M. D.

Facts:

On July 1st,  1971 —The "Warren Gazette", a weekly American newspaper published an article entitled "Hearing in Ribeira Grande, Portuguese Consul appeals fine".

On July 8th, 1971 - - the same newspaper "Warren Gazette" published a second article entitled "Portuguese Consul in Rhode Island Fined $3300".

On July 10, 1971 — "Providence Journal" published the following article "De Carvalho fined, but still consul".

July 16, 1971— "Fall River Herald News" -- front story — "Lawyer Appeals Azorean Court Fine for Helping Emigrants".

October 1971-- "Consular Review" published in Washington by International Academy of Consular Corps, published an article entitled "Portuguese Consul Fined".

None of the above American publications were sued by Manuel De Carvalho, who was the Portuguese Consul in Providence, R. I., and therefore a PUBLIC FIGURE.

He and his lawyer knew that they had NO chance of suing any of the American publications, based on the famous case New York Times Versus Sullivan (Public Figure).

Why, then, did DeCarvalho give me FOUR LAW SUITS, half of million each, totaling TWO million dollars?

I wrote two articles in Portuguese and spoke twice on the radio "The Voice of the Azores", in Newport, basing my writings and comments on the facts that the American publications were basing themselves upon, but I even obtained, on my own, further evidence:

I got copies of the sentences from the three Portuguese Courts in which Manuel DeCarvalho was found guilty of being and ‘engajador’ of emigrants, which is a criminal offense in Portugal. He being a Portuguese consul should know the Portuguese Law. He only wanted to exploit the emigrants, instead of helping them.

BECAUSE I WAS NOT A MEMBER OF A NEWSPAPER, OR A MEMBER OF A RADIO STATION, IN ANOTHER WORDS, I WAS NOT A MEMBER OF THE MEDIA, THEREFORE, I HAD NO RIGHT TO SPEAK, NOR TO WRITE THE WAY I DID!!!

This reasoning was not only ridiculous, but obnoxious.

The Founding Fathers when they created the First Amendment gave the FIVE SACRED LIBERTIES to ALL American Citizens, not for a selected few that are members of the MEDIA!

The First Amendment of the Bill of Rights of the American Constitution: Only 45 words!

(1) Freedom of religion; (2) Freedom of speech; (3) Freedom of the press;(4) Freedom to assemble; and (5) Freedom to petition, or protest.

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof, or abridging the freedom of speech, or of the press; or the right of the people peacefully to assemble, and to petition the Government to a redress of grievance"

This is the very reason why I decided to get the two best Lawyers in the State of Rhode Island — Knight Edwards and Joseph Cavanaugh of the Company Edwards and Angell— a give a tremendous fight to DeCarvalho, all the up to the Supreme Court.

Mission accomplished: Manuel A. DeCarvalho, the S.O.B., LOST in ALL FIVE Courts: three in Portugal and two in the U. S. A.!

As a full-fledged American Citizen, I vindicated the FIVE SACRED LIBERTIES CONTAINED ON THE FIRST AMENDMENT OF THE U.S.A. CONSTITUTION!

THIS CASE ESTABLISHED THE PRECEDENT THAT ANY CITIZEN HAS THE SAME RIGHTS AS ANY MEMBER OF THE MEDIA TO CRITICIZE A PUBLIC FIGURE!

This drama happened already 30 years ago!

What you are about to see is the most complete display of all the official documents of the PORTUGUESE MERDAGATE which took five years to resolve.

There are more than one thousands pages of documents. Those of you, you are lawyers will find much valuable information, references to famous American cases and a large bibliography.

This case became famous because it is the FIRST in U. S. A. History that reached the Supreme Court base on writings and speeches that were done in a language other than English, in this case the language was Portuguese.

There is a Portuguese proverb that says:
"Um  homem com razão é mais forte que urn leão!"
"When a man is right he is stronger than a lion!"

Have fun, my friends!  This is, indeed, original stuff and already belongs to the history books!
